Before selling you an annuity, the producer or insurer must have reasonable grounds, based on your finances, tax status and objectives, for believing the annuity is suitable for you. This is New Jersey's statutory suitability standard; it does not use best-interest language.

New Jersey excludes the part of each annuity payment that represents return of your own investment in the contract; the remainder is taxed as New Jersey gross income, subject to the state's separate pension and retirement income exclusions.

Fixed annuities are insurance products, so they are overseen by the state insurance department rather than by the SEC. The department licenses the carriers and the producers who sell them, and it takes consumer complaints.
