What Maine law says

Free-look period

Maine's general right to examine and return a policy (24-A M.R.S. § 2515-A) covers individual life insurance policies, not annuity contracts. The only annuity free-look right comes from the disclosure rule: if you weren't given the buyer's guide and disclosure document at or before you applied, Maine requires a free-look period of at least 15 days to return the annuity contract without penalty.

What your agent owes you

A producer recommending an annuity must act in your best interest and may not put the producer's or the insurer's financial interest ahead of yours.

How Maine taxes annuity income

Maine starts from your federal adjusted gross income to compute state tax, so the taxable portion of a privately purchased annuity is taxed as ordinary Maine income; a separate deduction applies only to pension or annuity income paid from a qualified employer retirement plan.

Who regulates annuities in Maine

Fixed annuities are insurance products, so they are overseen by the state insurance department rather than by the SEC. The department licenses the carriers and the producers who sell them, and it takes consumer complaints.
